Terms and Conditions

Terms and Conditions are the rules and guidelines that explain how a company’s services can be used. They clearly state the rights, responsibilities, and obligations of both the company and the customer. These terms and conditions form a legally binding agreement between Mountain Adventure Trekking and the client/ customer(you). So, when you book a trip with us, you agree to these terms and conditions. Please read them carefully before confirming your booking.

1. Booking Process

Bookings can be made through our official website or via authorized third-party platforms.

All trip prices are quoted in USD. If payment is made in a different currency, the conversion will be based on the exchange rate provided by Nepal Rastra Bank on the transaction date.

A 30% deposit of the total trip cost is required to secure your booking. This deposit is refundable only if cancellation is made at least 21 days prior to your scheduled arrival date.

The remaining balance must be paid during the pre-trip briefing upon your arrival in Nepal. For your convenience, you can also make the rest of the payment in advance via bank transfer or credit card before your arrival.

2. Last-Minute Bookings

For trips booked within 10 days of departure, full payment is required at the time of booking. Please note that this payment is non-refundable.

Availability for last-minute bookings is not guaranteed and will depend on operational feasibility.

3. Payment Options

We offer multiple payment methods for your convenience:

Bank/Wire Transfers: Bank account details will be provided upon request. Any associated transfer fees are your responsibility.

Credit/Debit Cards: Payments can be made using Visa, Mastercard, or American Express. A processing fee of 4% will apply.

Cash Payments: Cash payments are accepted in USD, EUR, GBP, AUD, CAD, etc. For USD payments, only bills issued after 2009 and in denominations of $50 or $100 will be accepted.

5. Cancellation Process

To cancel your trip, please send us a valid written notice via email at least 21 days before the trip departure date. We can only process cancellations with proper notice and approval.

6. Cancellation and Refund Policy 

If you cancel at least 21 days before your arrival date, 30% of the total trip cost will be charged as a cancellation fee, and the remaining balance will be refunded to you.

If you cancel your trip 14 days before your arrival date, we will deduct 50% of the total trip cost as a cancellation fee, and the remaining amount will be refunded to you.

If you cancel your trip less than 14 days before your arrival date, we will deduct 100% of the total trip cost as a cancellation fee.

If you need to file a claim with your insurance company due to cancellation, we can assist you by providing supporting documents, such as a receipt of the funds paid.

In refund cases, banks may deduct a certain amount as a refund fee from the refund amount.

7. Rescheduling Policy

In case you have any changes in the travel plans and need to reschedule your trip, you need to send us a written email notice for such a change at least 21 days prior to the scheduled departure date. You should also mention the reasons for such a change. If you want to postpone the trip, advance the dates, reschedule, or transfer your trip to any other individual, then the fee of USD 200 per person shall be borne by the client. 

In case the client wants to transfer the trip, then it's their responsibility to find another person. It will not be the duty of the company to find another individual for you. 

8. Incomplete Trips

If a client is unable to complete the trip for their own reasons, the company will not be responsible for providing refunds for any unused meals, accommodation, or services. Additionally, if a client engages in any unlawful activity during the trip and is required to leave the country as a result, the company will not issue any refunds. 

9. Passport and Visa Requirements

For your trip to Nepal, you must have a valid passport of at least six months from the date of your arrival in the country. Likewise, you should obtain a visa to arrive in Nepal. You can have two options to obtain the visa. The first one is obtain the visa from the Nepalese embassy in your home country. And the other option is to acquire an on-arrival visa at the Tribhuvan International Airport. 

It is not the responsibility of the company to deal with your visa and passport validity. It is the responsibility of the client to obtain a valid passport and visa when travelling to Nepal. Likewise, the cost of a visa and airfare is not included in our package. These costs shall be borne by the client themselves.

10. Unforeseen Circumstances

Mountain Adventure Trekking Pvt Ltd always strives to provide smooth operations and services. However, there are certain events beyond our control that may require changes to itineraries or services.

These unforeseeable circumstances include, but are not limited to: 

  1. Adverse weather conditions
  2. Natural disasters (e.g., landslides, floods, earthquakes)
  3. Political unrest
  4. Flight Delays/Cancellations
  5. Road Closure
  6. Pandemic, Strike and many more

In case of these unforeseeable circumstances, the company shall not be liable for changes in itineraries and services. Hence, any additional costs or expenses that arise out of these uncertain and unpredictable events shall be borne by the client themselves.

11. Risk Acknowledgment

It is a known fact that a trip in Nepal, including trekking and tours, comes with its own set of inherent risks. Risks, including but not limited to illness, injury, property damage, or death, can be caused due to high-altitude, physical fatigue, natural disasters, accident and many more. Even though Mountain Adventure Trekking Pvt Ltd takes all the reasonable and precautionary measures, these risks cannot be completely eliminated but just mitigated. Hence, when you agree to the terms and conditions while booking with us, you are acknowledging and accepting these risks. So, in case of any such misfortune, such as injury, death, property loss, etc., Mountain Adventure Trekking Pvt Ltd, its employees, and agents shall not be held liable.

12. Travel Insurance

When you are travelling with Mountain Adventure Trekking Pvt Ltd, it is mandatory to be insured with travel insurance. While getting the travel insurance, you must choose the policy that covers various circumstances, including but not limited to medical expenses, hospital bills, personal injuries, helicopter rescue, weather-related and other delays, trip cancellations, loss of belongings, and repatriation expenses. 

It is the duty of the client to obtain the travel insurance and ensure that the travel insurance provides coverage for various situations.  The company shall not be responsible for any costs or expenses that are not covered by the client’s travel insurance. Any costs not covered by your travel insurance will be the client’s responsibility. 

Proof of insurance may be requested prior to trip commencement.

13. Domestic Flights Delay/Cancellation and Helicopter Services

Flights in mountainous regions are often subject to delays due to weather conditions. If flights are canceled or delayed, you may need to use helicopter services at an additional cost shared among passengers (up to five individuals). These costs are not included in the package price and must be covered by you.

14. Health and Fitness

Clients must ensure they are physically fit for their chosen activities. We recommend consulting with a physician before undertaking high-altitude treks. Any pre-existing medical conditions should be disclosed during booking.

15. Children

If the client under the age of sixteen (16) makes plans for a trip in Nepal with us, they must be accompanied by a legal guardian or parent.

16. Privacy Policy

We respect your privacy and follow the principle of confidentiality. We ensure that personal information collected during booking is used solely for operational purposes (e.g., permits). Your data will not be shared with third parties without consent unless required by law.

17. Publicity Consent

By participating in the trip, you give Mountain Adventure Trekking Pvt Ltd permission to use, share, and publish any photos or videos taken of you during the trip for promotional, advertising, or informational purposes. This content may be used across all types of media, now or in the future, without additional consent or compensation from you.

15. Complaints

Not happy with something? Let us know right away. Our staff are always ready to listen to your concerns or complaints and solve them immediately. 

18. Acceptance of Terms

If you are making a direct booking with us, all these terms and conditions clearly apply to you. However, if you are making a booking through an agent or third party, then their terms and conditions, in addition to ours, shall be applicable to you. 

19. Participant Behavior Policy

In case your acts and conducts is deemed unacceptable, then Mountain Adventure Trekking Pvt Ltd holds the right to cancel and terminate your participation in the trip. The unacceptable conduct includes, but is not limited to, involvement in illegal activities, acting contrary to the law, causing distress and tension among the fellow travelers, or any behavior that puts yourself, other travelers, or staff at risk. If this happens, you must leave the trip right away. No refunds or compensation will be given for any unused services, and you will be responsible for any costs or damages caused by your actions. Mountain Adventure Trekking Pvt Ltd’s decision in these matters will be final, and there will be no grounds for negotiations. 

 20. Legal Jurisdiction

We, Mountain Adventure Trekking Pvt Ltd is based in Nepal, and the terms and conditions are also governed by the laws and provisions of Nepal. So, in case of any disagreement and disputes arising out of these terms and conditions, they will be settled by the courts. Only the mentioned judicial bodies, i.e., Kathmandu District Court, Patan High Court, and Supreme Court located in Kathmandu, have rights to settle the disputes and claims. There won’t be any legal proceedings in foreign countries. 

Remember: By booking with us, you agree that any disputes will be resolved right here in Kathmandu, where our main office is located.
